1. Preamble and Identity

Welcome to Lunburg. We are the guardians of Fassi Haute Maroquinerie, dedicated to the preservation of the sacred work of the human hand. These Conditions of Sale govern the relationship between you, the Custodian, and Lunburg B.V., particularly concerning the "Commission" (purchase) of our functional art pieces via our digital atelier.

Throughout these Conditions, the terms "we", "us", and "our" refer to Lunburg B.V. The term "Services" refers to our website, features, and the provision of our works.


2. Definitions

To ensure precision and mutual understanding, we define the following terms:

  • "The Commission": The placing of an order for a Lunburg piece. This terminology reflects that our works are created with intent, not mass-produced.
  • "Custodian" or "Patron": You, the individual or legal entity entering into an agreement with Lunburg.
  • "The Work" or "Product": The tangible leather goods, hardware, or accessories provided by Lunburg.
  • "Atelier": The physical location in Fes, Morocco, where the works are realized.
  • "Shared Stewardship": Our proprietary 50-Year Warranty agreement.

3. Applicability and Acceptance

These General Terms and Conditions apply to every offer made by Lunburg and to every distance contract realized between Lunburg and the Custodian.

By visiting our site or commissioning a work, you agree to be bound by these Conditions. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

We reserve the right to update these Conditions. It is your responsibility to check this page periodically for changes. Your continued use of the website following the posting of any changes constitutes acceptance of those changes.


4. The Commission (Offers and Orders)

4.1 The Offer

All offers on our website contain a complete and accurate description of the products offered. The description is sufficiently detailed to enable a proper assessment of the offer by the Custodian. However, manifest errors or mistakes in the offer (such as obvious pricing errors) do not bind Lunburg.

4.2 The Agreement

The agreement is concluded at the moment the Custodian accepts the offer and fulfills the conditions set thereby (e.g., completes the payment process). Lunburg will immediately confirm receipt of acceptance of the offer via email. Until this confirmation is sent, the Custodian may dissolve the agreement.

4.3 Right to Refuse

We reserve the right to refuse any Commission you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. In the event that we make a change to or cancel an order, we will attempt to notify you by contacting the email provided.


5. The Nature of the Work (Product Conformity)

5.1 Organic Variation

Our works are crafted from "Perpetual Leather", an unsealed, vegetable-tanned material. Unlike synthetic or heavily corrected leathers, our material retains the "Badges of Life." Small scars, insect bites, wrinkles, and tonal variations are not defects. They are proof of the material's organic origin and authenticity. By Commissioning a work, you acknowledge that these nuances are inherent to the product.

5.2 Patina

You acknowledge that the visual character of the work will change over time. The leather will absorb oils, darken in sunlight, and develop a unique "Patina." This evolution is intentional functionality, not a quality failure.

5.3 Display Accuracy

We have made every effort to display as accurately as possible the colors and images of our products. However, we cannot guarantee that your device's display of any color will be accurate.


6. Valuation and Payment

6.1 Pricing

Prices are stated in Euros (EUR) or your local currency where applicable. Unless otherwise stated, prices for EU customers include Value Added Tax (VAT).

6.2 Price Changes

Prices for our products are subject to change without notice. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

6.3 Payment Handling

You represent that you have the legal right to use any credit card or other payment method utilized in connection with any transaction. Verification of information may be required prior to the acknowledgment or completion of any Commission.


7. Delivery and Transfer of Risk

7.1 Delivery Estimates

We will exercise the greatest possible care when receiving and implementing orders. The place of delivery is the address that the Custodian has made known to Lunburg. Any delivery dates provided are estimates required for the logistical movement of goods from our facilities to your hand.

7.2 Customs and Duties (Delivered Duty Paid)

To ensure a seamless experience for our global patrons, Lunburg acts as the responsible party for international logistics. We employ a DDP (Delivered Duty Paid) shipping model for all commissions.

  • EU Patrons: No additional duties or taxes apply.
  • International (Non-EU) Patrons: Lunburg covers all import duties, customs fees, and levies incurred upon the arrival of the work in your country. The amount paid at the time of the Commission is final regarding delivery costs; you will not be charged additional fees by the carrier or customs authority to receive your item. We assume the administrative and financial burden of importation on your behalf.

8. Right of Withdrawal (Returns)

We understand that a Lunburg commission is an investment. While European regulations prescribe a 14-day cooling-off period, we extend this courtesy to a 30-day period of reflection.

8.1 The Period of Reflection

You have the right to withdraw from the agreement and return the work within 30 days of the day on which you, or a third party designated by you (other than the carrier), acquire physical possession of the good.

To exercise your right of withdrawal, you must inform us of your decision by a clear statement (e.g., by email to concierge@lunburg.com) stating your order number and intention to return. You may use the model withdrawal form available upon request, but it is not obligatory.

8.2 Return Costs and Logistics

While we do not charge any restocking or handling fees for returns, the direct specific cost of the return transportation is borne by the Custodian.

You are responsible for arranging the return shipment. We strongly recommend using a trackable shipping service or purchasing shipping insurance, as Lunburg cannot guarantee that we will receive your returned item.

8.3 Condition of Returns

To be eligible for a full refund, the work must be returned in the exact state in which it was received:

  • Unused and unblemished: The leather must not show signs of wear, oil absorption, or "Patina" development.
  • Complete: Returned in its original dust bag and packaging, with all warranty cards and documentation intact.

We reserve the right to refuse a return or deduct for diminished value if the item shows signs of use or damage that occurred while in your possession.

8.4 Refund Process

Once your return is received and inspected at our facility, we will send you an email to notify you of the approval or rejection of your refund. If approved, your refund will be processed, and a credit will automatically be applied to your original method of payment within 14 days.

8.5 Exclusion for Personalized Items

Important: The right of withdrawal does not apply to works that have been clearly personalized (e.g., monogrammed items) or commissioned to specific, non-standard bespoke specifications.


9. Shared Stewardship (The 50-Year Warranty)

At Lunburg, we do not view the sale as the end of the process, but the beginning of a relationship. Our Shared Stewardship program warrants your piece for fifty (50) years.

9.1 What is Covered

This warranty covers functional failures resulting from defects in materials or the artisan's workmanship, including:

  • Failure of the Rempliage (folded edge) construction.
  • Hardware breakage (zippers, locks, clasps).
  • Stitching failure.
  • Structural collapse of handles or straps.

9.2 What is Not Covered

This warranty implies a partnership. We build it to last; you must care for it. The warranty does not cover:

  • Standard "Patina" (darkening, softening, or shining of leather).
  • Damage caused by misuse, neglect, or overloading.
  • Damage caused by chemical exposure (perfumes, sanitizers, harsh cleaners).
  • Damage from water saturation (though the leather is resilient, it is not waterproof).
  • Theft or loss.

9.3 Claim Process

To initiate a stewardship claim, contact the Atelier via concierge@lunburg.com. We will assess the issue. If covered, we will repair or, at our discretion, replace the item. If the item is no longer in production, we will replace it with a comparable work.

9.4 Statutory Rights

This warranty is provided in addition to, and does not affect, your statutory rights under Dutch law and applicable EU consumer protection laws.


10. Intellectual Property

The content of our Services, including but not limited to the text, designs, logos, photography of the Artisans, and the "Lunburg Master Artisans" brand, are the intellectual property of Lunburg B.V.

You are strictly prohibited from using our proprietary terminology (such as "Art of Rempliage", "Perpetual Leather", or "Shared Stewardship") for commercial purposes without our express written consent. You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission by us.


11. Privacy and Data Protection

We respect your privacy and process your personal data in accordance with the GDPR. For full details on how we collect, process, and secure your data, please refer to our Privacy Policy.


12. Limitation of Liability

To the extent permitted by law, Lunburg B.V. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; or (iii) unauthorized access, use, or alteration of your transmissions or content.

Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or for fraud or fraudulent misrepresentation.


13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of The Netherlands.

13.2 Dispute Resolution

We encourage you to contact us directly regarding any concerns. If a dispute cannot be resolved amicably, it shall be submitted to the exclusive jurisdiction of the competent courts in the district where Lunburg B.V. has its registered office (The Netherlands).
